Software Agreement

Legal Agreement Introduction

By creating an account at any of the Poker Online Network sites, you agree to the following General Agreements/Terms and Conditions. The rules are considered a binding agreement between you and PokerOnlineNetwork. PokerOnlineNetwork strongly urges you to read the agreement carefully and make sure you fully understand its contents. It is the responsibility of each Player to read the entire contents of our rules pages before signing up with PokerOnlineNetwork. Furthermore, PokerOnlineNetwork advises each player to consult the rules at least every 30 days as PokerOnlineNetwork reserves the right to change the Agreements as well as the Terms and Conditions herein at any time.

Software Player Agreement: This Agreement is between PokerOnlineNetwork.com Limited, an International Business Corporation incorporated pursuant to the laws of Curacao, hereinafter ("PokerOnlineNetwork"), on the first part and you the end user, hereinafter ("Player"), on the second part, and sets out the terms and conditions for the use of PokerOnlineNetwork's Client Software Application, hereinafter (the "Software"); If Player does not agree to the PokerOnlineNetwork terms herein, Player must delete the Software from Player's computer. Use of this Software will constitute an acceptance of all of the terms herein.

Applicability of Terms and Conditions: By clicking on the "Accept" or "Continue" button, Player represents and warrants that Player fully understands and agrees to comply with all of the following terms and conditions, and that failure to abide by these terms and conditions may result in disqualification, account closure, forfeiture of funds and/or legal action against Player. If Player has any questions as to these terms and conditions, PokerOnlineNetwork encourages Player to seek independent counsel prior to clicking on the "Accept" or "Continue" button.

Web Site Content: Player does not find the Games or the Web site to be offensive, objectionable, unfair, nor indecent. Player shall hold the Company, its employees, officers, directors, Players, distributors, wholesalers, affiliates, subsidiaries, advertising, promotion or other agencies, media partners, agents and retailers harmless and shall fully indemnify the same from any and all costs, expenses, liabilities and damages whatsoever that may arise as a result of Player's; (i) entry, use, or reuse of the Web site, (ii) use of any materials at the Web site, (iii) entry, use, or reuse of the Game Servers, (iv) participation in the Game, or, (v) the acceptance of any Prize.

Rules, Instructions and Policies: The use of the Software by Player shall be made in accordance with, and governed by, but not limited to, the rules, instructions and policies as detailed in the Software application and/or PokerOnlineNetwork's Internet Web Sites.

No Warranties: PokerOnlineNetwork expressly disclaims any warranty either expressed or implied for the Software. The Software and any related documentation is deemed to be provided on an "AS IS" basis. The entire risk arising out of the use or performance of the Software remains with the Player.

Copyrights and Trademarks: The term PokerOnlineNetwork is the trademark, service mark and/or trade name of PokerOnlineNetwork. Further, all material on PokerOnlineNetwork, including but not limited to images, pictures, graphics, photographs, animations, videos, music, audio, text, and the Games belongs to PokerOnlineNetwork and is protected by copyright law. You obtain no right to use such terms, graphics, text, concepts or methodologies, by using PokerOnlineNetwork and the materials contained therein and/or herein.

Limitation of Liability: To the maximum extent permitted by applicable law, PokerOnlineNetwork shall in no event be liable for any direct, indirect, or consequential damages whatsoever including, but not limited to, damages for loss of business profits, business interruption, loss of business information, or any other loss arising out of the use or misuse of the Software.

Age Restriction: All Player(s) must be 18 years of age or the legal age of majority in their jurisdiction whichever is greater. No persons under this age limit are permitted to use the Software in any way.

Termination: PokerOnlineNetwork may terminate this Agreement if Player fails to comply with the terms and conditions of this Agreement. PokerOnlineNetwork shall refund Player any funds that may be in Player's account over and above any amount which may be owing to PokerOnlineNetwork, if any. Termination by PokerOnlineNetwork as described herein, shall be without prejudice to other rights. In such event of termination by PokerOnlineNetwork, all PokerOnlineNetwork software applications must be removed from the Player's computer(s).

Security: Player agrees that he / she / they is / are solely responsible for all use of the Software through Player's Player ID and Password. The Player is obliged to keep his / her Player ID and Password secret and confidential. Any unauthorized use of the Player ID or Password shall be the sole responsibility of the Player and be deemed by PokerOnlineNetwork as Player's use. The Player is responsible for all liabilities resulting from negligence of their security responsibilities.

Suspension, Modification and Removal of Games: PokerOnlineNetwork reserves the right to suspend, modify, remove and/or add any Game in its sole discretion and without notice. In the event of such suspension, modification, removal or addition of any Game for any reason, PokerOnlineNetwork will not be liable.

Applicable Law/Jurisdiction: This Agreement, the interpretation and execution thereof, and the relationship between the Parties, shall be governed by, and construed in accordance with, the laws of Curacao. Any claim or dispute arising either directly or indirectly out of this Agreement shall be brought before the competent court of the country of Curacao, which court shall have exclusive jurisdiction. Notwithstanding the foregoing, PokerOnlineNetwork shall have the right to initiate any legal proceedings against Player before any competent court in PokerOnlineNetwork's sole discretion including Player's home jurisdiction.

Termination: This Agreement may be terminated by either Party at any time. Upon termination of this Agreement, PokerOnlineNetwork shall transfer to the Player any remaining balance in the Player's PokerOnlineNetwork account after deduction of any amount that the Player may owe PokerOnlineNetwork pursuant to this Agreement.

Cancellations: PokerOnlineNetwork reserves the right to suspend or withdraw any Game in its absolute discretion and/or to add further Games from time to time. PokerOnlineNetwork also reserves the right to amend the House Rules and/or the basis of play of any Game or relevant Game Rules at any time. In the event of the cancellation of any Game for any reason, the Game Room will not be liable.

Agreement Changes: This Agreement may be modified or amended, without notice, by PokerOnlineNetwork, at its sole discretion, however, any modification or amendments shall be posted on the PokerOnlineNetwork Web Sites prior to implementation.

Policy Changes: PokerOnlineNetwork reserves the right to modify or amend site policies, without notice, at its sole discretion, however, any modification or amendments shall be posted on the PokerOnlineNetwork Web Sites prior to implementation.

Third Party Liability: The Player agrees that PokerOnlineNetwork shall not be liable for any transfers of data or funds carried out through a third party, including but not limited to: wire transfer, airmail, postal service, Western Union and any other method of transfer through Third Party Transfer. PokerOnlineNetwork shall not be liable for any malfunction, delay or error in the Player's software, hardware, telecommunications services, or third party software / hardware and services.

Interpretation: In this Agreement the headings are used for convenience only and shall not affect its interpretation. References to persons shall include incorporated and unincorporated persons; references to the singular include the plural and vice versa; and references to the masculine include the feminine.

Player Representation and Warranties: The Player hereby represents and warrants to PokerOnlineNetwork as follows:

A. The Player is of the age of eighteen (18) or the legal age of majority in their jurisdiction whichever is greater and is participating in playing PokerOnlineNetwork's online games for Real Money in a jurisdictions where it is legal to do so; has read this Agreement in its entirety and the Player has entered into this Agreement with full knowledge of the content herein or the Player has sought legal council regarding this Agreement and has entered into this Agreement with full knowledge of the content herein.

B. The execution, delivery and performance by the Player of this Agreement and the consummation by the Player of the transactions contemplated herein will not, with or without prior notice, the lapse of time or both, conflict with or violate:
(i) any provision of law, rule or regulation to which the Player is subject;
(ii) any order, judgment or decree applicable to the Player or binding upon the Player's assets or properties;
(iii) any agreement or other instrument applicable to the Player or binding upon the Player's assets or properties.

Liability: PokerOnlineNetwork is not responsible for claims, losses or damages resulting from playing PokerOnlineNetwork's online poker games for Real Money under any condition. The Player is playing against other players and not against PokerOnlineNetwork. Play at PokerOnlineNetwork is at the sole option, discretion and risk of Player.

Severability: If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability will not invalidate or render unenforceable any other part of this Agreement, but the Agreement will be construed as not containing the particular provision or provisions held to be invalid or unenforceable.

Acts of God/Natural Disasters: PokerOnlineNetwork shall not be liable for losses or damages to the Player which arise directly from an act of god; natural disaster; electrical, computer or communications failure; unclear instructions; fraud of any person(s) or entity(ies) other than PokerOnlineNetwork's employees or authorized agents.

Jurisdiction: Any matter or dispute arising from or relating to this Agreement between PokerOnlineNetwork and the Player shall be subject to the jurisdiction of the courts of the Country of Curacao.

PokerOnlineNetwork reserves the right to change the Terms and Conditions herein at any time.

House Rules

Email Subscription: The player, by providing their email address, agrees to receive email correspondence from the poker room at such address, from time to time. If the player does not wish to receive email correspondence to their email address, they may unsubscribe by following the unsubscribe instructions set out in the PokerOnlineNetwork's Privacy/Spam policy.

Nickname/Username/PID: An Alias is the name that Players in the Multi-Player environment know each other by. The following rules apply:

  • Players cannot have multiple Aliases. Each Player has only one Alias across all Poker Rooms in PokerOnlineNetwork.
  • No offensive Aliases are permitted. If you select an Alias that is considered offensive, your Alias is rejected, and you must select another Alias.
  • Players cannot change their Alias.
  • No Player may open more than one Real Money or play money account. Management will consider this a very serious issue and in its sole discretion may elect to suspend, terminate or freeze the funds in these accounts. No exceptions will be permitted.

General House Rules: Abusive or offensive language will not be tolerated in the multi-player Games or with PokerOnlineNetwork staff. Any violation of this policy will result in a suspension of playing privileges or such other action as may be required by PokerOnlineNetwork to ensure compliance.

PokerOnlineNetwork strives to provide players with the most safe, enjoyable, and modern gaming experience. While we give our total attention to our players, we also want to make sure our account holders practice proper etiquette while playing in any of our multi-player games. With this in mind, we have established a series of House Rules which we require that all of our members follow. PokerOnlineNetwork Anti-Collusion/Chip Dumping:

We at PokerOnlineNetwork have zero tolerance for players whom practice collusion or chip dumping. After a thorough and extensive investigation has been conducted and collusion or chip dumping has been determined, our PokerOnlineNetwork management team will either freeze, close accounts, reset balances, or even blacklist the corresponding guilty party. All necessary measures are taken so that our regular PokerOnlineNetwork account holders can enjoy a safe and fraud free gaming experience.
In order to ensure this, sophisticated technology and techniques are used to determine colluding and other types of fraudulent players.

Chat Etiquette

Etiquette is a matter of respect. Everyone enjoys a playing environment free from derogatory comments, vulgarity and offensive language.

1. Nickname/Username/PID:

The nickname/username/PID is the only means by which players identify each other in our virtual poker community. Furthermore, we will not allow nicknames that may be offensive to other players. PokerOnlineNetwork reserves the right to change inappropriate choices, or those that closely resemble others already in use.

2. Chat Language:

Abusive or offensive language will not be tolerated at PokerOnlineNetwork. Complaints will be dealt with swiftly and may result in a suspension chat and/or playing privileges.

3. Limiting Access by Minors:

PokerOnlineNetwork requires that new customers declare that they are of lawful age in their respective jurisdiction. We shall pursue measures to verify this information. ID verification may be required.

4. Public Profile:

PokerOnlineNetwork provides all players with the opportunity to submit a picture for their public profile. Please keep in mind that all approved pictures do not reflect in any way, shape or form PokerOnlineNetwork's philosophy, company policy, or views. When you view another players profile you are looking at the picture completely at your own risk. Nevertheless, all pictures submitted will be thoroughly screened for approval by customer support beforehand. PokerOnlineNetwork will not allow pictures that contain graphic images of the following nature: racial, defamatory, pornographic, anti-religious, or any other hate sponsoring type of picture.

Profanity/Insulting:

PokerOnlineNetwork will not tolerate players whom insult other players on basis of ethnic, social, sexual preference, playing technique, or any other type of profanity or derogatory remarks. This type of behavior can result in account closure or any other measure deemed appropriate by management.

This concept also applies with a player's username. Players who create a username that is in any way insulting or demeaning will be contact by PokerOnlineNetwork customer support and be properly assisted in creating a new account.

The Do's and Don'ts of Chat Room Conduct:

  1. NO offensive, indecent or abusive language.
  2. NO use of racial, sexual or ethnic slurs.
  3. NO cussing or off-colored remarks.
  4. NO complaining on the message board. Please Contact Us so that we may swiftly work to resolve the issue.
  5. NO harassment, slander, abuse or threaten of other players or PokerOnlineNetwork employees.
  6. NO exchanging of account information or status.
  7. NO impersonating another person in chat.
  8. NO mentioning, discussing or promoting of any other online gaming, affiliate or related sites.
  9. NO asking or hinting for a loan in chat.
  10. NO flooding in the chat box (multiple repeat line of text or characters).
  11. NO typing in all CAPS. Only CS Reps will be entitled to select usernames in all CAPS to help differentiate themselves from the other Players.
  12. NO collusion with another player of any sort or any other form of cheating.
  13. NO agreeing to check a hand when there is another player all-in.
  14. NO telling anyone your hole cards before a pot is complete.
  15. NO needlessly stalling the action in a game.
  16. NO selling or attempting to sell play chips for cash.
  17. NO attempting in any way to induce a player to leave a game to play in another.
  18. NO making statements that could unfairly influence the action in a game (for example: discussing cards that have been folded).
  19. NO chatting in any language other than English.
  20. NO begging other players for play chips or Real Money.
  21. NO advertising websites or other commercial services.

Do

  1. Have a great time!
  2. Encourage others in the room to keep things fun and lively!
  3. Be courteous and helpful to your fellow poker players!
  4. Respect the CS Reps and their authority at all times.
  5. Please contact us right away if anyone has been offensive to you in any way, so we can deal with them immediately. You can do this by copying the offensive message in an email and forward it to support so that we may make it our priority to review the chat log and take swift action.
  6. Play nice and be happy for all winners when they are winning - You wouldn't want anyone to be mean to you so don't be mean to others!

Consequences of Breaking House Rules
The House reserves the right to do the following:

  • Disqualify any Players who do not follow Game rules, or that act inappropriately during a game.
  • Unless otherwise stated, players found guilty of breaking the house rules will:
    • 1st Violation - Players chip dumping or colluding will have balance reset. Players violating their chat privileges will have a 48 hour chat suspension.
    • 2nd Violation - Players chip dumping or colluding will have balance reset and account banned for life. Real Money players will have a 10% processing fee charged and account banned for life. Players violating their chat privileges will have their account locked for 1 month.
    • 3rd Violation - Players violating their chat privileges will have their chat revoked for life.
    • PokerOnlineNetwork reserves the right to accelerate or slow down the process on a case by case basis, alter the rules and make final decisions on all game related issues as they occur.
  • All decisions are at the discretion of the House, and are final.

Fraudulent Activity: PokerOnlineNetwork reserves the right to hold any or all of the Player's funds indefinitely if the Player has been determined, at the sole discretion of PokerOnlineNetwork, of being involved in fraudulent activity on PokerOnlineNetwork. Fraudulent activity may include, but is not limited to, stolen credit cards, transfer of funds to other player accounts (chip dumping), forgery, using any type of robot device and collusion. PokerOnlineNetwork reserves the right to request additional documentation to verify accuracy of account login information. If such information is not provided, PokerOnlineNetwork may use its sole discretion to determine eligibility.

Disclosure of Fraudulent Activities: If, in PokerOnlineNetwork's sole determination, the Player is found to have cheated or attempted to defraud the Games, PokerOnlineNetwork or any of its Affiliates, Principals, Employees, Subsidiaries or Authorized Agents in any way including but not limited to game manipulation or payment fraud, or if the Player makes untrue and/or malicious comments with regard to PokerOnlineNetwork's operation, PokerOnlineNetwork reserves the right to publicize the Player's actions together with the Players identity and e-mail address, as well as to circulate this information to other online gaming sites, banks, credit card companies, and appropriate agencies. Further, PokerOnlineNetwork may close any accounts, and forfeit account balances, that Player has at PokerOnlineNetwork or at any other PokerOnlineNetwork website and/or business.

Security Checks and Reviews and Releases: To maintain a high level of security, PokerOnlineNetwork reserves the right to conduct a security review at any time to validate the Player's identity, verify the Player's financial transactions and further document the Player's consent to this Agreement. To facilitate these security checks, the Player agrees to provide such identification or other information or documentation as PokerOnlineNetwork, in its unfettered discretion, deems necessary. If the Player fails to comply with any security request, PokerOnlineNetwork reserves the right to void the Player's Account. The Player will be notified of such verification request by electronic mail and Account Balances will be forfeited if the Player does not sign and return any required affidavit of identity and eligibility, release of liability and/or publicity authorization. Likewise, PokerOnlineNetwork reserves the right to conduct an in depth analysis of hand history whenever PokerOnlineNetwork deems it necessary. Investigations may last as long as PokerOnlineNetwork deems necessary.

Policies: The Player agrees to use the Software in accordance with the Terms and Conditions stated in this Agreement, the License Software Agreement and the Policies stated on PokerOnlineNetwork's Web Sites.

Disputes: In cases where disputes arise between players, the Player agrees that any judgments of PokerOnlineNetwork are final, binding and conclusive in all matters.

Banking Rules

General

Real Money Play Agreement: This Agreement is between PokerOnlineNetwork.com Limited, an International Business Corporation incorporated pursuant to the laws of Curacao, hereinafter ("PokerOnlineNetwork"), on the first part, and you the Player of the Software as depicted in the Software License Agreement, hereinafter the ("Player"), on the second part, and sets out the terms and conditions for playing PokerOnlineNetwork's online games for Real Money.

PokerOnlineNetwork agrees to provide secure e-cash transaction processing. PokerOnlineNetwork, in co-operation with the industries top payment processing partners, provides the Player a safe and reliable means of depositing and withdrawing funds to the Player's Real Money account. All the Player's funds shall be held by PokerOnlineNetwork "in trust" and shall be held segregated from PokerOnlineNetwork's general accounts. By opening a real money account, the Player agrees to all contents of the General PokerOnlineNetwork Terms and Conditions.

Game Legality: No Player under the age of eighteen (18) or the legal age of majority in their jurisdiction whichever is greater is permitted to participate in real money games at PokerOnlineNetwork. The Player agrees not to participate in real money games in jurisdictions where it is illegal to do so. It is the player's sole responsibility to check the legality of play in their individual jurisdiction. Due to recent U.S. government legislation, PokerOnlineNetwork no longer accepts any players from United States in Real Money mode. However, we welcome all players to continue to enjoy our games in Fun Money or Play for Fun mode. Under no circumstances will PokerOnlineNetwork be held liable for the Players actions.

Number of Real Money Accounts: No Player is permitted to have more than one Real Money account. If a Player has been determined to have opened more than one account, PokerOnlineNetwork reserves the right to close the Player's account(s) but one account and transfer any existing funds from the closed accounts to the single remaining account or in cases that PokerOnlineNetwork deems it necessary, render all wins accumulated null and void. Multiple offenses may, without limitations, result in the permanent ban of the Player from PokerOnlineNetwork.

Player Account Security: The Player is responsible for maintaining the secrecy and security of their account passwords and other personal security information, as depicted in the Software License Agreement. The Player shall be liable for any authorized or unauthorized use of their PokerOnlineNetwork username and password throughout the term of this Agreement.

Taxes, Duties and Fees: All taxes, duties and fees applicable in connection with any money or prizes awarded to the Player are the sole responsibility of the Player.

Money Laundering: It is recorded that some jurisdictions have strict laws on money laundering that may impose an obligation upon us to report you to the federal or local authorities within such jurisdictions if we know, suspect or have reason to suspect that any of your transactions, amongst other things, involve funds derived from illegal activities or are intended to conceal funds derived from illegal activities or involve the use of PokerOnlineNetwork to facilitate criminal activity.

If we have knowledge or suspicion of money laundering we may:
- immediately suspend, deregister or terminate your Account at PokerOnlineNetwork; and/or
- at our sole discretion, not refund to you any funds held in such Account; and/or
- exclude you from all or any other PokerOnlineNetwork sites as well as any subsidiary companies; and/or
- furnish any relevant information about you to an intra-group database recording such mischief. You hereby irrevocably authorize us to do so in our absolute discretion.
- We reserve the right to report you to the aforementioned federal or local authorities should we, in our absolute discretion; determine that we are obliged, by law, to do so.
- In order to assist in the prevention of money laundering: No substantial and/or exceptional withdrawals individually and cumulatively shall be made unless notarized facsimile copies of at least 2 (two) of the following are received:
1. Most recent bank statement for the bank account from which your wagers have been paid;
2. driver's license;
3. social security card or a similar document containing a photographic identification of you;
4. current and valid passport; or
5. utility bill (e.g. gas, water, telephone etc) bearing your name and your address registered with us.

Depositing

Depositing Real Money: To play the Real Money Games, the Player will be required to deposit bona fide funds into the Player's Account by any of the methods specified at PokerOnlineNetwork; this may change from time to time in PokerOnlineNetwork's sole discretion. Generally, said funds will be promptly deposited into the Player's Account upon actual receipt of funds by PokerOnlineNetwork and/or its agents. Minimum and maximum limits apply to deposits depending upon the Player's history with PokerOnlineNetwork, the method of deposit, and other factors as determined solely by PokerOnlineNetwork. All funds will be paid, tracked and maintained in United States Dollars, except as otherwise stated, and shall not bear interest.

Deposit Methods: The following are the deposit methods currently available:
- Visa/Mastercard: Requires an up to date Secure Banking Form
- Check
- Cash
- Neteller (except for US Citizens)
- Moneybookers
- Epassporte

TIP: For the fastest cash in, we recommend that you use our web wallets like ePassporte.

No Third Party Deposits are allowed. All information used to deposit must match the information registered on the player account. Failure to comply with this policy will result in immediate confiscation of all funds.

Depositing by Credit Card: Unfortunately, due to new banking legislations, some credit card companies do not allow credit/debit card deposits to be completed. Please contact support for personalized depositing assistance.

Deposit Limits: The minimum and maximum deposit limits vary according to the Deposit Method selected and the individuals Player Status.

Player to Player Transfers: Please keep in mind that you may only transfer funds to players having previously made real money deposits. The maximum transfer amount per week is $200; the minimum per transaction is $5.00. Non depositing players are not entitled to transfer ANY funds to another player. Their play will come under special scrutiny when they attempt to cash out as well as the receiving player(s).

Questions about Credit Card Charges: If the player has any questions pertaining to charges on their credit card they must contact support immediately with a detailed copy of their banking statement.

Missing Deposits: If the player believes that they preformed a successful deposit and it is not appearing on their PokerOnlineNetwork account balance, they must contact support with: the date, amount, method and transaction number.

Limited Access to Credit Cards: We welcome the players from the countries listed below as long as they understand that they are prohibited to deposit by credit card or to take advantage on any free chip offer. The countries are: Albania, Afghanistan, Armenia, Azerbaijan, Belarus, Belarussia, Bosnia, Bosnia and Herzegovina, Bulgaria, China, Curacao, Croatia, Czech Republic, Estonia, Herzegovina, Honduras, Hungary, Turkey, Indonesia, Kazakhstan, Kosova, Latvia, Lithuania, Malaysia, Moldova, Montenegro, Romania, Russia, Russian Federation, Serbia, Slovakia, Slovenia, Ukraine, Jordan, Thailand, Pakistan and Yugoslavia. PokerOnlineNetwork reserves the right to edit this list without prior notice. PokerOnlineNetwork reserves the right to limit any player's access to depositing by credit card on a case by case basis. We apologize to these customers for any inconvenience.

Withdrawing

Cash out Payments: Payouts may require the submission of an updated approved Secure Banking Form. Secure Banking Forms must be submitted by either fax or email. In the event that a player's submitted information is not factual and identical to register account information, withdrawals may be cancelled at the Managements discretion. To be eligible to any bonus or winnings, all PokerOnlineNetwork player accounts must have a valid name, address, e-mail address and telephone number. The Player must consult the Banking page on the PokerOnlineNetwork website for a listing of withdrawal options. The fees and transfer time back to the Player will vary depending on the withdrawal method selected and the current Player Status. All amounts cashed out are subject to the transaction limits and processing fees as set forth at PokerOnlineNetwork and may change from time to time in PokerOnlineNetwork's sole discretion.

Processing Fees: Players have the right to one free withdrawal every two weeks depending on your preferred depositing and withdrawing method, fees may apply. PokerOnlineNetwork.com reserves the right to charge a 10% processing fee in cases where accounts have little or no game activity registered. The definition of an active account is as follows:

- 100 raked hands in $0.50 tables or more

Withdrawal Methods: There are so many easy and efficient ways to receive your money. Unfortunately due to new banking legislation PokerOnlineNetwork cannot refund to any credit or debit cards. For security reasons, PokerOnlineNetwork will issue funds back to the same e-wallet account that the player used to deposit. Under NO circumstance with PokerOnlineNetwork ever issue funds back to an ewallet in another individual's name or another player. Processing to web wallets is the fastest way of receiving your winnings. The options available to our Players are:
- Neteller (except for US Citizens)
- Moneybookers
- Epassporte
- Check
- Cash
- Bank Wire

Ewallets: These are the recommended method of withdrawing since funds should appear in the Player's ewallet account within 1-3 days after the payout is approved. Players will receive one free payment by ewallet per week.

Other Methods: Clients will assume the cost of receiving funds in the other methods such as check, bank wire and western union. The fees vary.

Reversing or canceling a cash in: As long as a withdrawal request is listed as "pending", the player may cancel the withdrawal request from the Cashier. This type of transaction does not qualify for a redeposit bonus since it is not a deposit. If the withdrawal has already been approved, yet the funds have not been issued, a player may contact PokerOnlineNetwork support immediately to see if it is not too late to cancel the transaction and return it to their PokerOnlineNetwork account.

Possible reasons for a delay in cash in: The following are some reasons why a player may experience a delay in their cash in process:

- Incorrect account information.
- Does not have an updated Secure Banking Form or other requested information on file.
- PokerOnlineNetwork suspects that the player broke one or more of the House Rules therefore warrants an in depth investigation.
- The player has not complied with the bonus requirements necessary to qualify for a cash in.
- The players requested payment method is processed in batches therefore not every day: western union, check, bank wire, etc.

The withdrawal process:

- Verification: PokerOnlineNetwork will verify that the player has met all Terms and Conditions contained therein. This process takes approximately 2-5 business days but may be longer if further investigation is warranted.

- Processing: The player has met all Terms and Conditions resulting in a approved withdrawal in the system. The payment processing time varies depending on the method that the player requests their payment. The player may change the withdrawal method by contacting support as long as the funds have not been issued. This process takes approximately 1-3 business days depending on the method of deposit and payment that is selected.

Withdrawal Limits: The minimum withdrawal amount is $25. The maximum withdrawal amount varies according to the individuals Player Status.

Promotional Rules

General Bonus Rules

- Complimentary or bonus amounts credited by PokerOnlineNetwork into the Players account for promotional purposes may not be either deposited or withdrawn without first complying with the additional terms and conditions set forth in each bonus offering, and if none, then the terms and conditions set forth on the Standard Bonus Money Rules are by way of reference specifically incorporated herein. Further, PokerOnlineNetwork reserves the right to reclaim any bonus amounts if the Player does not use them within the period of time specified.

- Family or co-habitants are not eligible for referral bonuses. All bonuses are good toward one individual. Accounts with duplicate IP addresses, Names, Addresses, Telephone Numbers, email addresses, or other information may be restricted from bonuses at PokerOnlineNetwork's sole discretion.

- Any player exhibiting "bonus hunting/abusing" behavior may have their account terminated and/or bonuses seized. Bonus hunting/abusing behavior is defined by the management on a case-by-case basis.

- Each promotion offered may have its specific restrictions depending on the promotion sent by PokerOnlineNetwork and/or its affiliates. The restrictions on the promotion supersede all standard rules. Please read the restriction on the specific promotion before using it. Improper use of the bonus/free chip may result in forfeiture of winnings.

- PokerOnlineNetwork reserves the right to limit the number of times end users may participate in a promotion. Identity of participants will be determined on the basis of all or any combination of the following: name, mailing address, email address, credit/charge/debit card number, and any other forms of identification which may be required. Where multiple participation is permitted, PokerOnlineNetwork reserves the right to limit the number of bonuses that may be given to any one participant.

- For the purpose of all promotions, dates and times shall be calculated according to Eastern Standard Time (GMT -5).

- Promotions are only valid for the period as specified in the promotion offer communications and specific to referenced PokerOnlineNetwork site or Player(s).

- Irregularities between the name of the PokerOnlineNetwork account holder and the name of the individual identified with the method used to make deposits will invalidate any offer.

- A player's PokerOnlineNetwork account balance is divided into a cash balance and a bonus balance.

- When a player account is credited with a promotional bonus, these credits will be added to the player's "Bonus Balance".

- All Deposits will be added to the player's "Cash Balance".

- All winnings using the player's Cash Balance will be added to the player's Cash Balance.

- Promotions are for a limited time only and PokerOnlineNetwork reserves the right to terminate any promotion at any time without prior notice.

Poker Deposit Match Bonuses:

- All PokerOnlineNetwork promotions serve as a reward and a sincere thank you for playing at our website. Depending on the specific promotion, PokerOnlineNetwork will release a certain percentage of your Bonus Money Balance while you are playing at our Real Money PokerOnlineNetwork Tables. This policy can and will modify depending on the type of promotions that PokerOnlineNetwork will run. For specific details we recommend that you always refer to the bonus section of the individual PokerOnlineNetwork poker room's website or contact our customer support team for immediate assistance.

- Promotions are intended as a bonus to loyal players, and to attract new end users to PokerOnlineNetwork. PokerOnlineNetwork encourages end users to participate in promotions, but to refrain from abusing them. Any abuse of a promotion that comes to the attention of PokerOnlineNetwork may result in the cancellation of that promotion and/or future promotions.

- Transfers made between Accounts (player A transferring money to player B) do not qualify as a deposit for any bonus offer.

- PokerOnlineNetwork and/or its authorized agent may, in their sole discretion, limit the eligibility of end users or of any one end user to participate in promotions, and to restrict the eligibility of any group or category of end users to participate in promotions.

- PokerOnlineNetwork and/or its authorized agent reserve the right to modify, alter, discontinue or terminate a promotion at any time for any reason whatsoever without notice to end users, using reasonable efforts to provide such notice in advance.

- PokerOnlineNetwork and/or its authorized agent reserve the right to review transaction records and logs, from time to time, for any reason whatsoever. If, upon such review, it appears that end users or any one or combination of them are participating in strategies which PokerOnlineNetwork and/or its authorized agent in their sole discretion deem to be abusive, PokerOnlineNetwork and/or its authorized agent reserve the right to reclaim bonuses or any winnings for failed audits.

- PokerOnlineNetwork Rake Rebate Deposit Match Bonuses:

  • In order to be credited with a deposit match bonus money percentage you are entitled to, you must open an account and submit a real money deposit. You will be credited a matching amount of the bonus percentage you are entitled to in your Promo Bucks Balance (PB Balance).
  • Bonus Money cannot be withdrawn until it is converted to Real Money.
  • Bonus Money will be converted to Real Money simply by playing at ring games. Bonus money will be added to your account as a percentage of your rake contribution.
  • As you convert your Bonus Money it will be automatically credited your account in increments the amount depending on the individual PokerOnlineNetwork poker site.
  • You must have deposited the minimum deposit amount stated to be credited with the advertised deposit match bonus.
  • You can view your Unreleased Bonus Awards by logging into your DGN Poker Software and clicking on CASHIER. Once there, you may also view the breakdown of pending bonus money by clicking on the More Bonus Info button located in the lower left hand corner.
  • Once you convert your bonus money to real money, you may use the money to play at the tables or request a withdrawal.
  • If you lose your Real Money balance having bonus funds yet in your Bonus Money balance, you will not loose your pending bonus money credits. You are entitled to make a deposit and continue converting the bonus money to real money.
  • A time restriction on bonus money conversion may apply.

In the event of a dispute, the decision of PokerOnlineNetwork will be considered final.

Loyalty Comp Points Rules

Each time a Player plays at PokerOnlineNetwork $0.50/$1.00 or higher real money tables, they are rewarded with Loyalty Comp Points in proportion to the amount of hands played.

Loyalty Comps Points Formula:
For each $1 generated in rake on a $0.50/$1.00 table or higher, the player will receive 50 comp points.

Loyalty Comp Value:
Every 500 Comps are worth $1 Special Member Events
Every 1000 Comps are worth $1.00 Cash

The minimum comps a player may redeem for cash is 10,000.

Players may not redeem their PokerOnlineNetwork Loyalty Comp Points until they have become a depositing member.

Players are not entitled to redeem comps made off of player to player transfers before having made their first deposit.

Depositing players may not cash out accumulated Comp Points made off of free chips or previous comps.

Any non system generated loyalty comps may be maxed per day.

Please note that Loyalty Comp Points are non transferable.

Comp points or associated bonuses are a privilege offered to our loyal customers.

Management reserves the right to withhold those privileges without prior warning.

Tournament Rules

Multi Table Tournaments

Registration for a multi-table tournament will typically open 2 hours before the tournament's posted start time and will end 5 minutes before the tournament start time with some exceptions.

Once a player has registered for an event, their buy-in is non-refundable.

Un-registering from a Tournament. Players can un-register up to 5 minutes before the start of an online poker tournament. Players who have won their seats through a satellite can not un-register.

Unless noted for a specific promotion, all players will begin with the same chip amount.

At the beginning of a tournament, all players are seated at random and seat changes are not allowed.

The dealer button is randomly assigned at the beginning of a multi table tournament.

For freerolls, if a player does not show up within five minutes of the tournament start, that player will be automatically removed from the tournament or that player will be blinded out (bankroll will be depleted through blinds).

During the tournament, all information will be displayed in the tournament detail window.

As a tournament progresses the tournament software combines tables and maintains an equal number of players at the remaining tables.

When balancing tables, the software will move players in such a way that they will remain in the same proximity to the blinds as they were from the table they were moved from.

In limit tournaments bets are limited to 4 during each betting round, the initial bet plus 3 raises. This is true regardless of the number of players remaining in the tournament.

If there is a split pot, not equally divisible by the number of players in the hand, the 'extra' chips will be awarded to the player closest to the left of the button.

In tournaments, when two players get eliminated in the same hand, the person who started the hand with the most chips gets the higher finish and awarded the corresponding prize pool for that placement.

When two players remain in the tournament, the player due to receive the big blind will inherit the dealer button.

Hand-by-hand dealing may be enacted during any tournament. This means that the tournament software will wait until a hand is played at all remaining tables, before dealing the next hand. This discourages the practice of slow playing.

In the event of a tournament crash or cancellation due to technical difficulties, the prize pool will be divided in half all remaining players will receive an equal share of half the prize money; and the other half of the prize money will be allocated to the chip leaders (chip leaders will be determined by the number of places the tourney would have paid) in proportion to their chip count. In the event a Tournament pays a fixed prize, such as a WSOP seat, the distribution will be based on chip lead. If a tie in cheap lead occurs, management will contact players to arrange a poker match to determine the winner.

PokerOnlineNetwork does not support private deals between players in tournaments, nor will the Poker Room assist in facilitating these deals or be liable in any way for broken deals or transactions not honored by one of the parties.

Disconnects

By participating in an online poker tournament, a player accepts the risk of Internet disconnection due to problems with the connection between their computer and the servers, lag or freeze, or other problems in the player's computer. PokerOnlineNetwork does not accept any responsibility for a player disconnect except in the case of a server crash.

If a player times out during a hand, whether connected or disconnected, the All-in Security will be in effect, if the player has no more All-in security available his or her hand will be folded.

If a player is not connected before a hand starts, he or she will be dealt cards, a blind or an ante will be posted, and then a hand will be folded automatically.

Our standard all-in policy applies to our tournaments.

During game play, players are prohibited from chatting about the play of their own and/or their opponents' hands until all actions for that hand are complete. Such chat could result in disqualification or other penalties.

Tournament registration must meet the minimum requirement for that event or the tournament will not run. In this event, all buy-ins and fees will be returned to the players' accounts.

Soft playing or chip dumping is not allowed. Players involved in these or other unethical activities may be eliminated from a tournament and/or have their accounts terminated.

Tournament players must adhere to the rules outlined in our User Agreement.

PokerOnlineNetwork reserves the right to disqualify any player who does not follow tournament guidelines or acts inappropriately during a tournament.

PokerOnlineNetwork reserves the right to change any tournament time, guaranteed prize pool, or event without notice.

PokerOnlineNetwork reserves the right to alter the rules and make final decisions on all tournament related issues as they arise, and at our sole discretion.

In case of disputes decisions made by PokerOnlineNetwork are final.

Single Game/ Sit n Go Tournaments

Unless specified as a play-money tournament, all buy-in fees and entry fee requirements must be met before a player is eligible to enter a single-table online poker tournament. This must take place before the start of each event.

Once the specified number of players have registered and taken their seat, all Texas Hold'em and Omaha poker tournaments start automatically.

Once a player chooses a seat and the tournament begins, they cannot change seats.

Refunds are automatically given to players only if they leave the table prior to the tournament starting.

The online poker tournament will end once one player has won all the chips. Once a player has lost all of their chips, they are automatically eliminated from the poker tournament.

Breaks are not given during sit and go tournaments.

All players begin with equal chip amounts in our standard sit and go tournaments.

The button is randomly assigned to a player at the beginning of the tournament.

Tournaments are played until one player has all the chips

In tournaments when two players get eliminated in the same hand, the person who started the hand with the most chips gets the higher finish and awarded the corresponding prize pool for that placement. If the players began the hand with the same amount of chips, they will tie and the prize pools will be combined and equally distributed. (For example, if 2 people who started a hand with the same number of chips are eliminated at the same time and would be 9th (which pays $60) and 10th (which pays $40), their standings would show tied for 9th and each player would be paid $50).

Players who have an active internet connection and do not act during their turn will be folded.

PokerOnlineNetwork uses the dead button feature to ensure that all players take the big blind in their turn. As such, it is possible that a player will receive the button for more than one hand. It is also possible that a big blind is posted in a hand but no small blind, if the person who was to receive the small blind was eliminated from the tournament in the previous hand.

Players who lose connection during an event will be blinded off until such a time they can rejoin their tournament.

The remaining players in the event will be paid the prize money based on their chip stacks and standings in the tournament at the time the tournament stops running.

Free Tournament Entry Rules/Freerolls

All depositing players that receive free access to any tournament will be required to play a minimum of 250 raked hands on any $.25 / $.50 table or higher or have $40 worth of tourney fees before placing a withdrawal. If these restrictions are not met, the sum of the buy in and fee will be deducted from customer's balance before the withdrawal is approved.

All players must be of legal age in their jurisdictions. Most World jurisdiction legal age is 21. It is player responsibility to ensure that he/she is in compliance with the local law.

All players must play throughout tournament. Incomplete tournament voids winnings. If the player loses their connection and cannot reconnect, the prize will not be awarded. If tournament crashes prizes will not be awarded. In such case tournament will be rescheduled at PokerOnlineNetwork's discretion.

All players must complete real money registration in full. Invalid registration will void winnings.

Players cannot transfer freeroll winnings to another account. If he/she does this his/her winning will be confiscated and account banned. This also applies to receiving account.

Non depositing players are not entitled to transfer ANY funds to another player. Their play will come under special scrutiny when they attempt to cash out as well as the receiving player(s).

In order to cash out freeroll winnings player must generate X comp points (loyalty points) based on the following formula = winnings x 100. Example: player wins $50. He/she must play until they earn 10,000 comp points.

To prevent underage gambling and money laundering each new player must make a deposit and verify account before withdrawing funds from the freeroll winnings. Player will be requested to email or fax a valid copy of the driving license and/or passport. Depending of the country of origin certain government ID's will be acceptable.

Collusion and/or dumping will void all play, funds will be confiscated and account will be banned.

Freeroll promotions are rewards to our players and are not intended for anything else but to attract new business and keep our friends and our new players happy.

Any Player having won freeroll money prior to having made a deposit, must send in a recent utility bill in their name and picture ID matching the name and address marked in their account information in order to be eligible to cash out a free chip. PokerOnlineNetwork reserves the right to contact the player to confirm the validity of the account information.

All players must have made at least one deposit within the past month and met all play through requirements before being eligible to withdraw any freeroll money and/or winnings derived form the use of this money.

Poker Rules

All-In: If a Player does not have enough chips to bet during a hand, they are not forced to place the full bet amount. However, the Player must put all of their chips into the pot - this is calling All-In. The game play that continues among other Players is put into a side pot. The All-In Player has no share in this pot. In addition PokerOnlineNetwork allows two all-in protections in the case of disconnection per a 24 hour period. All-in protection will deem a player all-in for the amount he/she had already wagered prior to the disconnection.

The following rules apply:

  • A player has the right to two All-Ins through disconnection in a 24-hour period. When this limit is exceeded, the Player's hand folds and any chips the Player contributed to the pot is forfeited.
  • Players must be aware of their All-In status. When a Player reaches the All-In limit, they must request that the limit be reset.
  • Abuse of All-In protection, or suspicion by the House that a Player is purposely disconnecting from the Multi-Player Casino, may result in the following:
    • Players being disqualified and removed from the game.
    • Players forfeiting all buy-in amounts.
    • Players being permanently banned from PokerOnlineNetwork.

All Actions Stand: The Player determines the action they want to perform in a game by clicking the appropriate Action button. Once a Player has selected an action, it is final. Players must ensure they select the correct action.

Bet Limits: The following rules apply to Fix Limits:

  • Players cannot bet less than the minimum, or more than the maximum amount displayed. For example, in a $10 / $20 game, the minimum bet limit is $10 and the maximum bet limit is $20.
  • Bet limits are determined by the House per game and per table.

Bets and Raises:

The following rule applies:
- The betting is capped at four bets - one bet and three raises, per betting round. When the betting is capped, Players may only call or fold.

Blinds and Posts: The following rules apply:

In Texas Hold 'em and Omaha blind bets are used to start the game play. The Player to the immediate left of the Dealer posts the small blind. The next Player to the left posts the big blind. The small blind is half of the minimum bet limit. The big blind is a full bet at the minimum bet limit. For example, in a $10 / $20 game, the small blind is $5 and the big blind is $10.

When new Players enter a game they are given a choice to post now or wait for the big blind. Players that decide to wait, receive no cards until it is their turn to post the big blind. Players that decide to post, bet the equivalent of one big blind and receive cards immediately.

Both the big blind and the post are considered live blinds. This means that Players on the big blind and Players that posted can raise their own blind bets.

Players that sit out, miss one or more blinds, and then sit in again, must either wait for the big blind to reach them again before receiving cards, or post both a big blind to receive cards immediately.

Note:

If the Player on the small blind or big blind loss all their chips, the dealer-button moves and the blinds skip a Player for that round.

When a Player is seated at a ring game and does not have enough chips to post a blind, he can not play the hand. However, if the Player is in a Tournament, the residual chips are automatically posted to the required blind and deemed all-in.

Buy-in

If a Player leaves a game and returns to that game in less than thirty minutes, the Player must rejoin that game with the same amount of chips that they had at the moment of departure. If a Player leaves one game to play in another game and loses, the Player may return to the first game and play at a lower bet limit.

Leaving a Game: If a Player leaves a game and returns to that game in less than thirty minutes, the Player must rejoin that game with the same amount of chips that they had at the moment of departure. If a Player leaves one game to play in another game and loses, the Player may return to the first game and play at a lower bet limit.

Playing at More than One Table: Players may play at more than one table at the same time. The following rules apply:

- The House monitors Players that are playing at more than one table at the same time. This is to ensure that multiple-table play is not causing slow play. If the House determines that slow play is a result of playing at multiple tables, the Player is forced to play at one table only.

- Players may not allege distraction or confusion as an excuse for errors made when playing at more than one table at the same time. Players are urged to consider the risk involved in playing at multiple tables at the same time. Errors that occur because of multiple-table play are strictly the Player's responsibility.

- Players may not participate from more than one account at the same tournament or ring game.

Slow Play: The following rules apply:

If the Player has not placed a bet in the hand, they have thirty seconds to respond. Failing this, the Player's hand automatically folds.

If the Player has placed a bet in the hand, they have thirty seconds to respond. Failing this, the Player's hand automatically folds or is considered All-In.

Note: Repeated instances of slow play may be grounds for a Player to be removed from the table. This decision is at the discretion of the House. There is a sit out option for Players that want to exit the table. Players must use this option to avoid negative consequences.

Publicity: Players who win a sum regarded by the Management as worthy of publicity agree to make their self and/or likeness available for an event of such a nature arranged and paid for by PokerOnlineNetwork. PokerOnlineNetwork reserves the right to use first names, general location, and/or login name in any promotional announcement.

Fees:

  • Rake Fees: A schedule of the "Rake Fees" collected during game play in PokerOnlineNetwork's online poker games for Real Money are posted on PokerOnlineNetwork's Web Sites and are hereby acknowledged by Player. Rake Fees during game play in PokerOnlineNetwork's online poker games for Real Money are subject to change; however, all changes shall be posted on the PokerOnlineNetwork Web Sites prior to implementation.
  • Tournament Fees: The tournament fees are listed under the tournament lobby within the software.

Players are permitted to acquire additional chips only between hands. If a player runs out of chips during a hand, they are considered all-in.

Disconnects and Internet Delays
- Poker: In the event that the Player is disconnected during a game for any reason, our Software will consider the Player as All In. This "All In" protects the Player's investment in the pot. An explanation of the functionality of the "All In" is detailed on PokerOnlineNetwork's Web Sites. If the Player has no investment in the pot at the time of the temporary interruption, the Player's hand will be folded. PokerOnlineNetwork assumes no liability if the Player is disconnected, for any reason, during game play in PokerOnlineNetwork's online poker games for Real Money.

Time Outs: The Player is required to act on the Player's hand within 30 seconds of becoming the Player's turn. If the Player fails to respond prior to the 30 seconds lapsing, the Player shall be deemed "All In".
